KuCoin Review 2026: Austrian MiCA Licence, FMA Ban and EU Status
KuCoin is known for its huge range of altcoins and for listing new projects early. In Europe, however, its position is unusual: it holds a MiCA licence, yet the Austrian regulator has not allowed its European entity to commence operations. As of September 2026, EU residents cannot open a new account with the licensed side of KuCoin.

Does KuCoin have a MiCA licence?
Formally, yes. KuCoin EU Exchange GmbH in Vienna received CASP authorisation from Austria’s Finanzmarktaufsicht (FMA) on 27 November 2025 and launched its European platform in January 2026.
Within weeks, the staff responsible for anti-money-laundering and sanctions compliance left — roles a licensed firm cannot operate without. The regulator responded on two fronts:
- 18 February 2026 — a decision declaring the commencement of business inadmissible.
- 19 February 2026 — a ban on taking on new business.
- 18 May 2026 — the ban on new business was lifted once the roles were filled, but the prohibition on commencing operations remained, as not all conditions had been met.
A new managing director was appointed in August 2026, a sign KuCoin intends to unlock the EU market. Until the FMA decides, KuCoin should not be treated as an exchange operating in the EU.

Act before you have to: export your full transaction history, check withdrawal costs and consider moving funds to an exchange operating in the EU without restrictions — such as OKX, Bybit EU or Kraken.
The history adverts leave out
The 2020 hack. In September 2020, around $280 million in crypto was stolen from KuCoin’s hot wallets. Most was recovered or frozen and customers did not bear the losses, but it remains one of the largest incidents in the industry.
The US case. In January 2025, KuCoin’s operator pleaded guilty in the United States to operating an unlicensed money-transmitting business, agreed to pay over $297 million and to exit the US market, over missing anti-money-laundering controls.
Both link to what happened in Austria: KuCoin’s problems have long been about compliance, not technology. That is why its trust score sits well below its platform and offer scores.
